This privacy policy applies to this website, ioanalazanu.ro, managed by Ioana Lazanu, as the legal representative of IOL ARHITECTURA SI DESIGN SRL, headquartered in the city of Cluj-Napoca, 13-21 Fabricii de Chibrituri Street, Cluj county, having CUI no. 30016262, registered at the Cluj Court Trade Register Office under number J12/887/2012 and governs the privacy of all users who choose to use it.

Definitions
Client/Buyer – the natural or legal person who places an order for products and/or services offered by IOL ARHITECTURA SI DESIGN SRL.
User – the natural person using this website.
Seller/Provider – IOL ARHITECTURA SI DESIGN SRL, with the identification data indicated below.
Products and Services – any product or service, including documents and services mentioned in the Order, to be provided by the Seller to the Buyer.
Order – the operation by which the Client contacts the Seller to purchase the services and/or products that are part of the Seller’s commercial offer, as presented on the site.
Contract – the legal act concluded when the Seller’s acceptance of the order reaches the Client.

Registration
To register, you need to provide the following information about yourself: your name and surname as they appear on your identity card, email address, and phone number where you can be contacted. If one or more of the above information changes, please notify us by email at arhitect@ioanalazanu.ro.
To meet your requirements, the accuracy of this information is mandatory. Therefore, if this information is incorrect or insufficient, we reserve the right to block your access to the site without notice, for a period determined by us, without needing your consent. Additionally, an incorrectly indicated email address or phone number will result in the cancellation of the registration / order, as we will not be able to contact the customer.
Before purchasing any of the products listed on our website, please read the details and specifications carefully: price, description, dates and other estimates. To purchase one of the products or more, you must click the ADD TO CART button and then complete the fields on the checkout page.
Purchasing a product
If you purchase one or more products on our site, you consent to the use of your data (including added data) for the delivery of the products, services, and information requested. This also implies agreement with third parties involved in the above-described activity. With the acceptance of the T&C and IS, we have your consent to use the information you provide to prevent possible fraud. This information may be recorded by the competent authorities. If you are under 18, please inform your guardian about this action.
To purchase a product, you need to register your information in our database.
Pricing Policy and Payment Methods
Prices are set when the products are displayed on the site and include VAT. These may change if the discount policy (provided on the site) applies or if there are significant changes in the euro-lei exchange rate. All prices displayed on the site are in eur.
We reserve the right to cancel any order that has resulted from technical failures that have affected the characteristics of the products present on www.ioanalazanu.ro (e.g., situations where the price displayed on www.ioanalazanu.ro for a particular product is unrealistically low compared to other products with similar characteristics, as well as situations where incorrect characteristics have been displayed for the marketed products or certain essential characteristics have not been displayed).
Conclusion and Duration of the Contract
The contract takes effect from the date of payment, once the advance is paid, and remains effective until all contractual obligations are fully met.
We reserve the right not to accept certain orders, as well as the right to select our clients without offering additional justifications or explanations.
The contract concluded with IOL ARHITECTURA SI DESIGN SRL can be transferred/assigned by its holder to a third party, who must send us their personal data and confirmation by email to arhitect@ioanalazanu.ro.
Our services will always be used in accordance with the Regulations and Policies communicated by IOL ARHITECTURA SI DESIGN SRL.
Termination of the Contract
The contract terminates in one of the following situations:
(a) by mutual agreement of the parties; (b) at the end of the period for which it was concluded; (c) in the event of major force; (d) in the event of the beneficiary’s death; (e) by operation of law or a final court decision; (f) by termination of the contract by the beneficiary/IOL ARHITECTURA SI DESIGN SRL, in accordance with the provisions above.
Payment Methods:
Payment will be made exclusively online by card.
If the contract is not returned completed and signed, the continuation of organizational steps and, implicitly, a live or online consultancy participation represents confirmation of the contract between the two contracting parties.
Product Fee Refund Conditions:
You have the right to withdraw from the contract, in accordance with the provisions of OUG 34/2014, i.e., to renounce a service, within 15 calendar days from the date of payment, without giving any reason and without incurring any costs (when purchasing an online or live consultation, you have to right to withdraw from the contract before the meeting, within 15 calendar days from the date of payment).
If the contract has not been returned completed and signed, the date of payment made by the participant/buyer online is considered.
If the withdrawal is made after the 15-day period, the product fee is not refundable.
Legal entities are not entitled to withdrawal.
If you could not attend the meeting or something interrupted your attendance for reasons attributable to yourself, the amount paid is not refundable, regardless of the payment method (in installments or in full), but depending on the case we can offer you the opportunity to make up for the missed session.
Governing Law
The contract between IOL ARHITECTURA SI DESIGN SRL and the Buyer is governed by Romanian law and will be interpreted in accordance with its regulations. Any disputes will be resolved amicably.
If amicable resolution of disputes is not possible, they will be submitted to the International Commercial Arbitration Court attached to the Romanian Chamber of Commerce and Industry, according to its regulations.
Force Majeure
None of the contracting parties is liable for the failure to perform on time and/or for the improper performance – in whole or in part – of any obligation under this contract, if the non-performance or improper performance of the respective obligation was caused by force majeure, as defined by law.
According to art. 1351 of the Civil Code, “(1) If the law does not provide otherwise or the parties do not agree otherwise, liability is excluded when the damage is caused by force majeure or by a fortuitous event. (2) Force majeure is any external event, unpredictable, absolutely invincible, and inevitable.”
During the period of invoked force majeure, all deadlines are suspended.

Processing of Personal Data
IOL ARHITECTURA SI DESIGN SRL processes personal data in accordance with European Regulation 679/2016 (GDPR) and current national legislation. This site is the exclusive property of IOL ARHITECTURA SI DESIGN SRL.

accounting, administrative, and economic-financial management, for the organization and management of financial accounting and management of trainees and contracted services;

conducting research and/or analysis for statistical purposes;
for direct marketing purposes, to assess your needs and provide recommendations regarding the types of services and courses that best match your options.
Rights of the Data Subject:
Right of Access – Art. 15 of the European Regulation 679/2016 (GDPR)“The data subject has the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the following information: a) the purposes of the processing; b) the categories of personal data concerned; c) the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations; d) where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period; e) the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing; f) the right to lodge a complaint with a supervisory authority; g) where the personal data are not collected from the data subject, any available information as to their source; h) the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.”
Right to Rectification – Art. 16 of the European Regulation 679/2016 (GDPR)“The data subject has the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, the data subject has the right to have incomplete personal data completed, including by means of providing a supplementary statement.”
Right to Erasure (‘right to be forgotten’) – Art. 17 of the European Regulation 679/2016 (GDPR)“The data subject has the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller has the obligation to erase personal data without undue delay where one of the following grounds applies: a) the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; b) the data subject withdraws consent on which the processing is based according to Article 6(1)(a) or Article 9(2)(a), and where there is no other legal ground for the processing; c) the data subject objects to the processing pursuant to Article 21(1) and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2); d) the personal data have been unlawfully processed; e) the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject; f) the personal data have been collected in relation to the offer of information society services referred to in Article 8(1).”
Right to Restriction of Processing – Art. 18 of the European Regulation 679/2016 (GDPR)“The data subject has the right to obtain from the controller restriction of processing where one of the following applies: a) the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data; b) the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead; c) the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims; d) the data subject has objected to processing pursuant to Article 21(1) pending the verification whether the legitimate grounds of the controller override those of the data subject.”
Right to Object – Art. 21 of the European Regulation 679/2016 (GDPR)“The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions. The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims. Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing. Where the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.”
Right Not to be Subject to Automated Individual Decision-Making, including Profiling – Art. 22 of the European Regulation 679/2016 (GDPR)“The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her. This shall not apply if the decision: a) is necessary for entering into, or performance of, a contract between the data subject and a data controller; b) is authorized by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests; or c) is based on the data subject’s explicit consent.”
